1. Introduction
Welcome to ServiSeek (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services"). The Services form a marketplace that connects individuals or businesses seeking services ("Buyers" or "Customers") with local service providers ("Service Providers" or "Traders").
By registering for an account or using our Services, you agree to be bound by these Terms. If you are acting on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service
ServiSeek is a neutral venue that facilitates connections between Customers and Service Providers. We are not a party to any agreement or contract formed between a Customer and a Service Provider. We do not employ, recommend, endorse, or control any Service Provider. You are solely responsible for evaluating, selecting, and engaging a Service Provider.

3. Accounts and Responsibilities

Eligibility: You must be at least 18 years old to use our Services.

Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
4. Service Provider Accounts and Responsibilities

Verification: Service Providers must complete our verification process, which may include providing proof of identity, business registration, and relevant qualifications or insurance where legally required for their trade.

Representation: Service Providers represent and warrant that all information provided on their profile is accurate and that they possess the necessary skills, qualifications, and insurance to perform the services they offer.

Direct Relationship: The Service Provider is solely responsible for the quality, timing, and performance of the services they deliver. The Service Provider, not [Platform Name], is the employer or contractor of any personnel they use.
5. Job Posting and Bidding Process

Job Requests: Customers will provide an honest description of the work, including scope, timeline, and budget (if any). Customers are responsible for the accuracy of this information.

Bids: Service Providers may submit bids for jobs they are qualified to perform. Bids should be clear, include a total price or estimate, and outline the proposed work, and whether further costs may be liable.

No Obligation: Submission of a bid by a Service Provider is not binding until formally accepted by the Customer. Similarly, a Customer is under no obligation to accept any bid received.

Acceptance: A contract for services is formed directly between the Customer and the Service Provider once a bid is accepted via the Platform.

6. Payment and Financial Terms

Direct Payment: Customers agree to pay Service Providers directly for services rendered, based on the agreed-upon quote. Payment methods are arranged directly between the Customer and the Service Provider.

Platform Fee: Service Providers agree to pay ServiSeek a success fee (commission) for each job won through the Platform. The fee will be 0% of the total job value (ex VAT). An invoice for this fee will be issued upon job acceptance and must be paid within 14 days of the job closure date.

Disputes: ServiSeek is not responsible for resolving payment disputes between Customers and Service Providers. We encourage parties to resolve disputes amicably between themselves.
7. Cancellations and Refunds

Cancellation by Customer: Customers may cancel a job request before a bid is accepted without penalty. If a Customer cancels after accepting a bid, any cancellation policy agreed upon directly with the Service Provider will apply.

Cancellation by Service Provider: If a Service Provider cancels a confirmed job, they should provide the Customer with as much notice as possible.

Repeated cancellations by either Customers or Service Providers may lead to suspension from the Platform.

Refunds: Refunds for work performed are a matter to be resolved directly between the Customer and the Service Provider. ServiSeek is not liable for any refunds.

8. Customer and Service Provider Conduct and Reviews

Prohibited Conduct: You agree not to use the Platform to post false, misleading, or defamatory content, or to harass other users. You will not attempt to circumvent the Platform's payment system or exchange contact details to avoid fees.

Reviews: Customers and Service Providers may leave reviews about each other. Reviews must be truthful, factual, and not contain offensive language. [Platform Name] reserves the right to remove reviews that violate these Terms.

Where a Service Provider objects to a review on the basis that it is dishonest and defamatory, ServiSeek would request evidence of the Service Providers' claims before removing the review.
9. Limitation of Liability
To the fullest extent permitted by law, ServiSeek and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in any way connected with the use of Services by either Customers or Service Providers.

You acknowledge and agree that ServiSeek is not liable for the acts or omissions of any Service Provider, including for any personal injury, property damage, or other loss or damage resulting from the services provided.

10. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of ServiSeek or its licensors and is protected by copyright and other intellectual property laws.

11. Termination
We may suspend or terminate your account and access to the Services at our sole discretion if you breach these Terms. You may also terminate your account at any time.

12. Governing Law and Disputes
These Terms shall be governed by the laws of the UK. Any disputes shall be subject to the exclusive jurisdiction of the courts of the UK.

13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Platform. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
